China, Britain boost trade ties (AFP)

LONDON (AFP) ? China's Wen Jiabao and Britain's David Cameron unveiled trade deals worth ?1.4 billion at a summit Monday, but their efforts to boost closer bilateral ties were undermined by differences on Libya and human rights.

The Chinese and British premiers expressed optimism about the future of their relationship after talks at Downing Street, their second formal meeting following Cameron's visit to Beijing in November.

But Wen rejected criticism about his country's treatment of dissidents -- one of whom, Hu Jia, was released hours before the premier flew into Britain late Saturday -- and also warned NATO that its military campaign could not bring peace to Libya.

Since taking office in May last year, Cameron's coalition government has made relations with China a priority and says it wants to increase bilateral trade.

At Monday's summit, he and Wen unveiled deals involving oil and gas group BG and spirits giant Diageo among others, and agreed the reopening of the Chinese poultry market for British exports, which was halted after a bird flu outbreak.

"I am delighted that today's summit has seen new deals signed worth ?1.4 billion ($2.2 billion or 1.6 billion euros)," Cameron told a press conference.

Britain is scrambling to catch up with European rivals Germany and France, after French firms secured contracts worth $20 billion last year.

Both Cameron and Wen expressed optimism about their bilateral trade prospects, which Britain has said it hopes to increase to $100 billion (70 billion euros) a year by 2015.

But the small crowd of demonstrators who gathered outside Downing Street, brandishing posters saying "Cameron and Wen: human rights before trade" and "Free Tibet", highlighted a sticking point in the relationship.

Cameron said he and Wen had discussed human rights, adding: "There is no trade-off in our relationship. It is not about either discussing trade or human rights."

"We should show each other respect. But we're very clear that political and economic development should go hand in hand, that one supports the other," Cameron said.

However, Wen batted away any implied criticism, insisting that China was pursuing political reform.

"On human rights China and the United Kingdom should respect each other, respect the facts, treat each other as equals, engage in more cooperation than finger-pointing, and resolve properly our differences through dialogue," he said.

The two leaders also discussed the ongoing bombing campaign in Libya.

China abstained from voting on the UN Security Council resolution that authorised the action, and Wen warned that only the Libyan people themselves could bring peace.

"Foreign troops may be able to win war in a place but they can hardly win peace. Hard lessons have been learned from what has happened in the Middle East and Afghanistan," he said.

After the meeting with Cameron, Wen picked up an award from Britain's leading science institution, the Royal Society, for his commitment to science.

He then flew to Germany for the third stop of his European tour.

On his first full day in Britain on Sunday, Wen visited a car plant in Longbridge, Birmingham, central England, which is owned by Shanghai Automotive Industry Corp (SAIC), China's largest automaker.

He also visited Shakespeare's birthplace in Stratford-upon-Avon, where he watched a brief performance from "Hamlet". On Monday, he said the bard was one of the "greatest geniuses in our world".

During the visit to Britain, China's central bank chief, Zhou Xiaochuan, voiced support for French Finance Minister Christine Lagarde's bid to lead the International Monetary Fund, in Beijing's first public statement on the issue.

Answered Prayers: My Adoption Story

As the oldest of five children, I grew up with one sister and three brothers. I loved and helped care for them starting when I was quite young. Mothering came naturally to me, and by the age of 11, I knew when I grew up, more than anything else, I wanted to be a mother as well. I began collected baby clothes and quilted a special baby blanket in high school that I kept in a hope chest for the child I would have one day.

I fell in love with a man who also wanted children. Bill especially wanted to have a son he could teach to fish, ride a bicycle and play baseball with. From the first days after our wedding, we set out to have our special family. Our conversations centered around our future children.

The months went by, then two years passed, but no baby came. Couples all around us seemed to get pregnant without even trying. I must have gone to a dozen baby showers during those early years of our marriage. I laughed with my friends as the expectant mothers opened their gifts, but I was crying inside. Pregnancy losses replaced my hopeful heart.

We decided to go see specialists, and we discovered that we both had fertility problems. I remember the months starting in the spring of 1985 as a blur of tests and fertility drugs, another ovulation on the temperature chart, more poking and prodding, the start of yet one more menstrual cycle.

We came to dread holiday gatherings because of the humiliating questions. Getting dressed before one New Year?s Eve party, Bill and I took bets on how many innocent insults we?d hear that night. Chuckling, he said 10, and that was about right for that year. The topper was when my Grandpa asked at the large dinner table in a fine restaurant, ?Haven?t you figured out how to do it yet?? Grandpa, ?We lost that page of the manual ? pass the pepper please? I said with a smile, though his words had pierced me to the bone.

Some friends I had confided in offered remedies they said had worked for people they knew. We were supposed to eat fish twice a day, make love on the night of a full moon, and I was to lie on a propped up board that stood me on my head for twenty minutes.

I started to avoid some friends and even my business associates, fearing that someone would ask when we were going to have children or if I was pregnant yet. We become more isolated from others, and depressed. Bill and I continued to see a specialist who was growing less hopeful each visit. As the months passed, life did not seem so bright.

As the owner of a busy medium-sized manufacturing company, I had come to believe that if you wanted something bad enough, worked hard and smart enough, you could have it. But that didn?t seem to help with pregnancy. As the CEO, I came to expect that when I needed something, I could pick up the phone and have it delivered. But I could not order a baby. It was out of my hands and into Gods.

In my spiritual life, I came to wonder, since I was sure that God wanted us to have children, why He had not blessed us with a family. Was I doing something wrong? I prayed for an answer and prayed for a baby.

An avid reader, I bought books on infertility and human reproduction, on infant care and early childhood development. I hoped that somehow a baby might pop up out of a book as a result of all my study. My library and knowledge grew but my womb was still empty.

I went to the little neighborhood library almost every day (there was no Internet yet), and the afternoon librarian became my friend. One morning she silently pushed toward me a book on adoption and smiled shyly, then turned. I took it over to a table and set it down in front of me. Sitting in the chair, I looked over its cover and the back text, but I could not bring myself to open it. I pushed it away and got on with my research into getting pregnant.

When I left the library, I had checked the book out along with a few others on adoption, gently setting the adoption books next to me in the passenger seat, I glanced down at them just laying there, perhaps hoping for a miracle

Late that night, I opened it and started to read them in my den. It was scary, as I thumbed through the books; all were 15 years out of date and written about the old method of adopting, which seemed cold, secretive and extremely formal. Then I read another book about current adoption practices, which seemed warm, honest and comfortable.

After some really bad news from our doctor, Bill and I lay in bed staring at the ceiling one night talking. I saw the door to adoption was slowly opening, just as the door to making our own baby seemed to be closing shut.

Within days we made the decision to adopt. Immediately, it seemed like there was light shining into our lives once again. We were excited about our future seeing our life with children.

And then, our day arrived ? we adopted our son.

With prayer and patience, we made the right decisions and my hope for you is that you will also prayerfully make the right decisions. We started our adoption with a hope and very little money. We had to make sacrifices but I knew that my desire to hold a baby in my arms was stronger than any desire for material items.

My adoption was not without challenges, but I believe that my challenges were a blessing in disguise. God was preparing me for the work I do today: helping others become parents and helping babies find their forever homes through what is now Lifetime Adoption Center.

Christine Lagarde named IMF chief

France's Christine Lagarde, 55, has been named the first woman to head the International Monetary Fund (IMF).

The announcement of her appointment came soon after she received the backing of the US and Russia.

Ms Lagarde, the French minister of finance since June 2007, was up against Mexico's Agustin Carstens. An IMF statement said that both candidates "were well qualified".

The post became vacant following the resignation of Dominique Strauss-Kahn.

"The results are in: I am honoured and delighted that the board has entrusted me with the position of MD of the IMF!" Ms Lagarde said via Twitter minutes after the announcement.

In a statement, the IMF said: "The executive board of the International Monetary Fund today selected Christine Lagarde to serve as IMF managing director and madame chairman of the executive board for a five-year term starting on July 5, 2011."

Ms Lagarde, it said, was "the first woman named to the top IMF post since the institution's inception in 1944".

The 24-member board called both Ms Lagarde and Mr Carstens "well-qualified candidates" and that it decided on Ms Lagarde "by consensus".

Mr Strauss-Kahn resigned abruptly on 18 May after being arrested in New York for an alleged sexual assault.

Microsoft puts Office in the cloud, confronts Google (Reuters)

SEATTLE (Reuters) ? Microsoft Corp is making its biggest move into the mobile, Internet-accessible world of cloud computing this week, as it takes the wraps off a revamped online version of its hugely profitable Office software suite.

The world's largest software company is heaving its two-decade old set of applications -- including Outlook email, Excel spreadsheets and SharePoint collaboration tools -- into an online format so that customers can use them on a variety of devices from wherever they can get an Internet connection.

It wants to push back against Google Inc, which has stolen a small but worrying percentage of its corporate customers with cheaper, web-only alternatives, which remove the need for companies to spend time on installing software or managing servers.

"It's obvious that Microsoft has to do this if they're going to remain competitive with Google," said Michael Yoshikami, chief executive of money manager YCMNET Advisors. "It's something they have to do."

Microsoft shares rose 3.7 percent on Monday, the largest gain in a single trading day since September, partly buoyed by hopes that it can ultimately boost profits by extending its software dominance to the growing cloud sector.

"If they execute effectively and it's adopted, it could be a game changer," said Yoshikami. "Whether or not that will happen is a whole other story."

Microsoft has offered online versions of some Office programs -- chiefly Outlook email -- for its corporate customers for several years, and last year rolled out free versions for individual home users.

Chief Executive Steve Ballmer is set to present an overhauled and updated set of offerings -- collectively called Office 365 -- at an event in New York City on Tuesday morning, underlining the company's newfound online focus.

GROWING MARKET

The market for web-based software services is heating up, and every company, government department and local authority is getting pitches from Microsoft and Google whenever they reevaluate their office software.

It's a new challenge for Microsoft, which built itself up on expensive versions of software installed on individual computers. That business model turned the Office unit into Microsoft's most profitable, earning more than $3 billion alone last quarter.

Microsoft's plan is to make up for smaller profit margins from web-based applications -- due to the cost of handling data and keeping up servers -- by grabbing a larger slice of companies' overall technology spending.

Last October, when it rolled out a test version of the new service, Microsoft said it planned to charge from $2 per user per month for basic email services to $27 per user per month for advanced offerings. Google charges a flat fee of $50 per user per year for its Web-based Google Apps product, which offers email, calendars, word processing and more online.

Microsoft, like Google, will host users' data remotely, and maintain all the servers in vast data centers. Unlike Google, it will also allow companies to put their data on dedicated servers if they choose, or keep the data on their own premises.

The full launch of Office 365 will spice up the lively competition with Google for new users.

Earlier this month, Google snagged InterContinental Hotels Group as a major customer, moving 25,000 of its employees onto Google email from Outlook.

Google, which has had the most success in the small and medium-sized business range, says there are now 40 million users of online Google Apps suite. Microsoft does not publish equivalent numbers, but research firm comScore has estimated 750 million people worldwide use Office in some form.

But Internet-centric Google -- whose success is based on its dominance in web search -- is confident it has the upper hand in the cloud.

"Compared to what they (Microsoft) have in the market today, they have nowhere to go but up," said Dave Girouard, head of Google's worldwide enterprise business. "We feel we're years ahead of them in terms of building a viable cloud solution that just works."

At first glance, a trademark can be a complicated and expensive legal process. This is the story of how I successfully registered a trademark for a total of $275 (the minimum USPTO fee).

When I started to think about a trademark, I visited a lawyer.??He wanted over $1,000 to manage the process, and told me I would regret submitting it myself. ?He said I wouldn?t be equipped to respond if the application was challenged.

Moreover, the?application is?confusing.??What is a trademark class???What description should you use for your goods/services??What qualifies as a specimen to prove use in commerce? ?It?s no wonder most fork over the cash to a lawyer.

Wondering how it turns out?

I decided to break down the process by researching the implications of making a mistake. ?During my research, I found that only 3% of trademark applications are challenged. With those odds, I decided I could apply myself, and then go to a lawyer if it was challenged.

All that was left was filling out the application, and this turned out to be more simple than expected.??Since you can search trademarks on the?USPTO Site or?Trademarkia, you can find similar trademarks (e.g. competitors) and look for patterns. ?Other questions had simple answers as well. ?For example, all you need for a specimen to prove use in commerce is a screenshot of your site. ?I filled out the form in less than an hour, and?6 months later we received the trademark certificate pictured above.

Hurray!

Okay, so my sarcasm is a little obvious. It isn?t meant to be all that sarcastic. This is, rather, a teaching moment.

But first, the disclaimers.

I don?t have a substantial practice in trademark ?prosecution,? i.e., filing trademark registration applications. ?That?s why I don?t write all that much about PTO practice here. ?I am often involved in the preparation of more ?interesting? applications, or work on applications involving a bigger tactical or litigation picture, but prosecution is not primarily what I do. ?So, on that score, I have little or no bias in favor of the employment of lawyers for such tasks.

Moreover, I think in the coming years lawyers will do less and less of this work, whether they ought to or not. ?To the extent they do, it will be done by lawyers who make a living by doing a lot of it, and at a very economical price. ?(I like Erik Pelton for that, by the way.)

Having said that, I am not even going to pass on the outcome Aaron reports on here except in one respect: ?Anyone who looks at the percentage of applications that are bounced by the PTO, or even the question of whether or not you ?successfully? obtain a registration, as the only ? or even the main ? inquiry in this process is, well, a non-lawyer.

Let?s put it this way. ?My main work in trademark is litigating infringement claims, see. ?And where there is a trademark registration, and I am representing a defendant? let?s just say that first look at the registration is when I reach for my revolver. ?And when I am trying to enforce a registration on behalf of a plaintiff, I am often hoping I?ll get no ?unhappy surprises.?

That?s because, as most readers of?LIKELIHOOD OF CONFUSION? understand well, not all registrations are created equal. ?Indeed, a bad registration can be worse for the proponent of an infringement claim, or a trademark holder seeking to protect and enforce its rights, than none at all in some cases. ?This is true despite the profoundly lessened threat of cancellation on the grounds of fraud on the PTO, which once could lead to loss of all the rights of registration merely by inadvertent or sloppy over-inclusion of goods and services claimed in the application.

But the fact is, if you end up litigating over that registration, or threatening to, you do have to get the goods and services ?right.? ?You have to know the difference between stuff you sell and stuff you?re going to sell, and what to call it ? because the PTO isn?t always going to ?get it.? ?You need be right about that date of first use, and to understand the difference between the date of first use and the date of first use in commerce.

You need to make sure it isn?t already someone else?s trademark. ?No, the PTO does not do that for you: ?They are only looking for potentially conflicting registrations, and even their determination on that score is not something you can hang your hat on if you are sued for infringement.

No, searching the PTO or Google or any other free database does not do that for you. ?And with all due respect, even if you find something that way ? if you?re not a trademark lawyer, you will not know what to do with it.

I said ?trademark lawyer.?

Don?t get me wrong. ?A homemade trademark registration ? or even one cranked out by Legalzoom or Trademarkia ? ?could be good for your business.

But unless you?re very, very fortunate, if you ever want to make use of that piece of paper, it?s more likely to be good for mine.

No more damage in flooded Minot as river ebbs (AP)

MINOT, N.D. ? The Souris River began a slow retreat from Minot on Sunday with no further flood damage in the city, but officials warned danger would remain for several days until the highest water passed.

"We're still at full alert until the water starts going down," said Shannon Bauer, a spokeswoman for the U.S. Army Corps of Engineers. "It's still a war."

On Sunday, North Dakota National Guard soldiers were monitoring a submerged pedestrian bridge in Minot to make sure it didn't break off in the river channel. The bridge has been trapping debris and could harm nearby levees. Guard commander David Sprynczynatyk said soldiers were ready to pull it out if it came loose.

Problems at Minot's water treatment plant prompted the state Department of Health to issue a boil order Saturday for users of city water. The order also applies to the Minot Air Force Base, about 13 miles north of town, which gets its drinking water from Minot's municipal system.

Once the Souris recedes, Minot will begin tackling the job of rebuilding.

The Federal Emergency Management Agency has approved Burleigh and Ward counties, which have some of the state's most extensive flooding damage, for individual assistance aid. Gov. Jacque Younger said the couple's recovery "is going to be very tough, because we don't have a lot of savings." But they tried to put the best face on it by thinking of how they might change things in rebuilding.

"You have to look on the bright side, because if you look on the dull side, it gets you down," Jacque Younger said.

One of the best books I?ve ever read is Keith Ferrazzi?s Never Eat Alone (here are some of my notes on Never Eat Alone). It really opened my eyes to the idea of how building lots of relationships based on something real can be really valuable and useful for all parties involved.

Prior to that, ?networking? really seemed? cheesy to me. I?d been around people who seemed to be ?networking,? but it constantly felt like I was just another person to push a business card on and call a ?contact? while their eyes were searching the room for a bigger fish to talk to. It felt almost deceptive, and it felt like something I didn?t want to have any part in.

Since then, I?ve been slowly building my list of personal relationships that I value, which, in the end, is what networking really is. If the relationship you?re building has no real value (and value is built by exchanging things of worth with each other, whether it be time, information, assistance, or other things), then that relationship is worthless.

This brings us to Dig Your Well Before You?re Thirsty. This book by Harvey Mackay has been recommended to me more times than I can count by people who have read my Never Eat Alone articles. I always resisted it because I had this general impression that it espoused the type of networking that I didn?t really like.

I finally gave this book a shot when a great reader sent me his copy of the book, insisting that I read it. Was it worthwhile? Let?s dig in.

Jump In, the Water?s Fine
You can?t accomplish really great things alone. You might write the great American novel all by yourself, but you can?t publish it and get it noticed without others. Every big thing you really want to accomplish in life, at some level, relies on the people around you. Thus, one important element of making those things happen is to build good relationships with lots of people. Mackay uses a ?well? metaphor throughout the book, and he makes the point that each time you do this, you dig your ?well? a bit deeper. In other words, every time you do this kind of positive thing, you build a new relationship or strengthen an old one.

Sharpen Your Edge
Your life is full of chances to build relationships. Think about how many people you see or interact with every day. There are likely many people in your work place. There are many people in your neighborhood. Each one of them is an opportunity for building a connection. You?ve got to make the first step, though. Each one of them is an opportunity, even if that opportunity is nothing more than the chance to sharpen your social skills and interaction skills.

Excavate Your Unique Skills

Some people, like the sleazy networking guy I mentioned at the start of this article, think that having a network is all that matters. It?s not. It might help open a door just a bit for you, but you have to have the character and the skills and the value to pull that door the rest of the way open. A network is just a network. It?s still up to you to be the right kind of person to handle whatever?s behind that door.

Minding the Well
If you want a relationship to be valuable, you have to maintain it. That means you have to maintain some degree of contact with that person. Perhaps even more important, you should maintain that relationship when things are up and particularly when things are down. When the chips are down, people remember who was still there for them and who didn?t have the time of day for them.

Is Dig Your Well Before You?re Thirsty Worth Reading?
I was surprised to find that Dig Your Well Before You?re Thirsty covers much of the same ground that Never Eat Alone covers. They both espouse building relationships that provide real value instead of merely ?networking.?

For me, the biggest difference in the two books was the way I perceived the authors. Mackay, the author of Dig Your Well Before You?re Thirsty, feels like an extrovert. Ferrazzi, the author of Never Eat Alone, comes off as an introvert. This bleeds over into the value of the book, in my opinion.

If you find starting conversations to be easy but haven?t ever really thought how that all comes together for you in terms of building a big set of relationships, Dig Your Well Before You?re Thirsty is a great book to read. On the other hand, if you find the mere mechanics of human interaction to be difficult at times, Never Eat Alone will perhaps click better.

Michelle Obama defends husband on Africa (AP)

GABORONE, Botswana ? Visiting Africa on a goodwill mission, first lady Michelle Obama defended her husband Friday against criticism that he isn't paying enough attention to the continent. She said her weeklong trip to South Africa and Botswana is proof of the president's commitment to Africa.

"This trip is a reflection, a direct reflection, of his support and his interest and his view of the importance of Africa to the world and to the future of the world," she said. "That's why I'm here."

Given that Barack Obama is America's first black president and his father was from Kenya, many had hoped to see stepped-up U.S. involvement on the vast continent during his presidency. Africans also longed for Obama to visit so they could welcome home a U.S president they consider one of their sons.

He did visit, stopping in Ghana in 2009. But he stayed less than 24 hours and has not been back to Africa.

The first lady said people expect a lot from her overworked husband and that some won't ever think what he does is enough.

"He would love to be here but there's a lot of work to do on the domestic front," she told four American reporters traveling with her. "And as president it's hard to predict and plan internationally because you've got domestic stuff hitting you left and right".

"Africa's absolutely important to him," she added. "I understand why people feel like they want more. It's a big continent, a lot of challenges. But I think his record and the number of senior officials who've spent so much time in Africa ... that is a reflection of this administration's commitment to this continent."

White House officials previously have pointed to the president's involvement in Libya, Sudan and Ivory Coast as examples of his commitment to Africa, along with repeat visits by such senior administration officials as Secretary of State Hillary Rodham Clinton.

Mrs. Obama said she is her husband's "direct representative" and as such she was the one who met Friday with Botswanan President Ian Khama. The two emerged from his office after about 45 minutes and shook hands for the news media. They made no remarks.

The White House said later that they underscored the "breadth and depth" of the relationship between their countries. Botswana is considered one of Africa's most stable democracies and has held 10 successive democratic elections since becoming independent in 1966.

Khama expressed appreciation for US assistance, including life-saving support for HIV/AIDS patients, the White House said. HIV/AIDS is a major public health challenge in Botswana, a Texas-sized country of 2 million people in southern Africa. About 300,000 Botswanans are infected with the disease.

They also discussed youth leadership, the key theme that Mrs. Obama has been promoting in Africa, and Khama's interest in conservation. Khama also sent his best wishes to Obama.

Mrs. Obama opened the second leg of her trip in Botswana on Friday by wielding a paint brush to help create a mural at a children's HIV/AIDS clinic sponsored by Baylor College of Medicine in Houston. The facility treats more than 4,000 children and their families.

The US has spent more than $450 million since 2005 to help Botswana deal with AIDS. The country's efforts and partnerships with academic institutions and foundations have helped more than 95 percent of infected Botswanans get treatment, officials said.

The first lady also had lunch with a group of women, many of whom have overcome personal challenges, and their mentors. She told them that she's proof that success isn't about money or connections because her parents had neither of those. It's "about how much one believes in their own potential," she said.

After the call on Khama, Mrs. Obama ended the day at the Mokolodi Nature Reserve, where family and staff had dinner.

The first lady is traveling with her daughters, Malia, 12, and Sasha, 10; her mother, Marian Robinson; and a niece and nephew, Leslie and Avery Robinson, 15 and 19, respectively. She began the trip Monday, spending two days each in Johannesburg and Cape Town in South Africa before moving on to Botswana.

She is due back at the White House early Monday, after a private family safari this weekend.

The Five Phases Of Relationships ? See Where You Are As Well As ...

All partnerships, and relationships for that matter, move through five predictable stages. Being aware of these phases is like having a map that may help you to accurately assess where you are and where you are able to go.

You figure out how to share power and appreciate one another?s unique abilities and gifts. However, it truly is still self-oriented ? ?What can I get out of this relationship?? rather than ?What can we create with this relationship??

Avoid false cooperation in which one person acquiesces to the other to be able to ?maintain the peace?. This is still Power Struggle, only in a far more subtle form.

Stage four ? Synergy

This is the stage where there is a realization of a power higher than that of each individual. There?s also a commitment to a specified focus and use of the power. Great satisfaction, intimacy, as well as a deep sense of mutual trust, empowerment and simplicity characterize this stage. It?s a highly creative, powerful relationship.

It also includes a high level of acknowledgment and appreciation. The relationship emanates joy and strength in this stage.

Stage five ? Completion

This can be a stage a lot of individuals fear and avoid dealing with altogether. There are four ways relationships can be completed: drifting apart, expulsion/ejection, conscious completion or death. At times completion is only about changing the form of the relationship, not necessarily the end of the relationship altogether.
